Event Details:

Diving is all about community. Once a year we act as a venue for divers to buy & sell their lovingly used gear, clothing & miscellaneous items to others in the community. As this is a community driven event, Triangle Dive Shop/Water World acts solely as a venue and will not warantee or guarantee any equipment sold by a 3rd party without a seperate inspection/service. Swap Meet Seller Terms & Conditions

Note: By registering as a seller you are agreeing to the following terms. You will also be required to sign the paper version of this agreement at the event check-in.

1. Independent Seller Status

You are participating solely as an independent seller of your own used equipment. Triangle Dive Shop (“TDS”) only provides table space and is not involved in any sale, pricing, negotiation, or representation of equipment. By hosting this event, TDS does not inspect, test, verify, certify, or guarantee any gear being sold.

This event is ONLY open to individuals who are not selling on behalf of a competiting dive shop.

2. Table Fee

You agree to pay a non-refundable $20 per table fee. This fee covers event space & setup only and is not tied to the value or number of sales. Payment of the table fee does not create any warranty, agency, or additional duty of care by TDS regarding any equipment sold.

3. Condition of Equipment

You remain fully and solely responsible for the legality, safety, accuracy, and serviceability of all items you offer for sale. All equipment is sold used and “as-is” with no express or implied warranty from TDS, except to the limited extent that TDS is separately hired to perform documented inspection or service work as described below.

4. Optional Inspections by Triangle Dive Shop

TDS is not responsible for certifying, approving, or declaring any equipment safe for use unless it is specifically hired by a buyer or seller to perform an authorized inspection or service. Any such work:

  • Is requested and documented under a separate work order or service/inspection request; and
  • Is performed outside of the Swap Meet transaction itself; and
  • Is subject to TDS’s normal service procedures, limitations, and fee schedule.

TDS does not warrant the state or future performance of any equipment sold at the Swap Meet unless that specific item has been separately serviced or inspected by TDS under a written work order, and then only to the extent stated in that work order or accompanying service documentation.

5. Required Buyer Notice

You agree to urge all buyers to have any purchased equipment professionally inspected, serviced, and verified by a qualified technician before use. You must clearly communicate that TDS, by hosting the Swap Meet, is not responsible for evaluating or certifying equipment, and that any inspection or service must be requested and documented separately.

6. Release of Liability

Except to the limited extent of any separate, documented inspection or service work that a buyer or seller specifically contracts for with TDS, you assume all risks associated with selling or transferring used scuba equipment. TDS is not liable for any injury, damage, loss, malfunction, or accident arising from or related to equipment you sell, or from your participation in the event.

Any liability related to separately contracted inspection or service work, if any, is governed exclusively by TDS’s standard service terms and the written work order for that equipment.

7. Indemnification

You agree to indemnify, defend, and hold harmless TDS, its owners, employees, and representatives from all claims, damages, losses, costs, and legal actions arising out of: (a) your participation in the Swap Meet; (b) the condition, use, or sale of your equipment; or (c) your representations to buyers. This indemnification applies regardless of whether a buyer or third party has separately hired TDS for inspection or service, except to the limited extent that a claim is based solely on TDS’s own documented inspection or service work under a separate work order.

8. Seller Conduct & Compliance

You agree to comply with all event rules and may not sell unsafe, recalled, expired, or prohibited items. You are responsible for securing your own equipment and personal property at all times.

9. No Shop Warranty or Involvement in Sales

TDS acts strictly as a venue provider and is not a broker, intermediary, or party to any sale. TDS does not make any warranty or guarantee regarding equipment sold at the Swap Meet. If TDS is separately hired to perform inspection or service on a specific item, such work is performed under its standard service terms, outside of the Swap Meet transaction, and does not create any broader warranty or obligation regarding other equipment or any other aspect of the event.

10. Governing Law

This Agreement is governed by the laws of the State of North Carolina. Any disputes arising out of or relating to this Agreement, the Swap Meet, or your participation shall be resolved in the state or federal courts serving Durham County, North Carolina.

You will be required to sign the full paper version of these Terms & Conditions at check-in before being allowed to sell.
