Triangle Dive Shop – Dive Trip Agreement & Contract

Thank you for signing up for a trip with us! This agreement is sent to our trip leaders to ensure we’re all on the same page. It also gives our trip leaders a chance to get to know you and your diving history before the trip so that they can plan accordingly.

Please note, if the participant is under 18 years old, their parent/guardian must fill out and sign

Liability Waiver & Release

I acknowledge that participation in scuba diving and travel activities involves inherent risks. I voluntarily release and hold harmless Triangle Dive Shop/Water World, its owners, guides, agents, staff, contractors, and affiliated providers (Collectively “Released Parties”) from any and all liability for personal injury, property damage, loss, accident, or death arising from participation in this trip, whether due to negligence or otherwise.

This release does not apply to any claims arising from the Released Parties’ gross negligence, reckless conduct, or intentional harm.

I acknowledge this waiver is supported by my trip deposit and acceptance into the dive trip (consideration).

I understand that important updates and details regarding the trip will be provided via email and I agree to read and respond promptly to ensure smooth planning and travel.

Retainer & Payment Schedule

I acknowledge that a non-refundable deposit is required to confirm my reservation. The remaining balance is due by the posted “Final Payment Date” listed on the trip flyer (Which is generally 90-120 days prior to departure). For reservations made on or after the listed “Final Payment Date”, full payment is due at the time of booking.

I authorize Triangle Dive Shop/Water World to process payments using the payment information I have provided for this trip.

Changes to Itinerary or Pricing

I understand that Triangle Dive Shop/Water World reserves the right to adjust trip details or pricing if necessary. In the rare event of a price increase, I will have the option to cancel my reservation for a full refund of monies paid.

Third-Party Services Disclaimer

I understand that Triangle Dive Shop/Water World acts as an agent for hotels, resorts, dive operators, airlines, transportation services, and other independent providers, and is not responsible for their acts, omissions, or failures. I acknowledge that any disputes, claims, or issues arising from services provided by third parties must be resolved directly with those providers.

Substitution of Services

I agree that, when necessary due to weather conditions, mechanical issues, local laws, or safety concerns, Triangle Dive Shop may substitute comparable accommodations, vessels, staff, dive sites, or trip components. No refunds will be provided for substitutions or services unused by personal choice.

Photo & Media Release

I hereby grant permission to Triangle Dive Shop/Water World, its representatives, and affiliated partners to photograph, video record, or otherwise capture my image, likeness, voice, or written testimonials during the course of this trip. I authorize Triangle Dive Shop to use, reproduce, publish, and distribute these photographs and recordings in any format—including print, digital, online, or social media— for marketing, promotional, educational, or commercial purposes without compensation to me. I understand that my name will not be used in association with my image or likeness without my separate, written consent unless otherwise required by law. I acknowledge that I have no right of approval or claim to royalties or other compensation arising from the use of these images or recordings.

I decline and do not wish my likeness to be used for promotional purposes.

Payment Schedule, Refund & Cancellation Policy

I acknowledge the below schedule, cancellation & refund policy. Resorts, charter companies and other service providers require payments on a strict schedule to secure their services. As such, we require timely payments from our participants so we can secure your spot for the trip.

Payment Schedule

Trip Retainer: Due at time of booking
90 Days prior to departure: Full Payment Due
All payment dates are listed on the trip information page

Refund & Cancellation Schedule

Trip retainer: Non-refundable
Cancelling within 90 days of departure date: 50% refund
Cancelling within 60 days of departure date: No refund

In the event of cancellation for any reason, including personal, medical, or unforeseen circumstances, I understand I will be refunded in accordance with the above refund & cancellation schedule. I also agree I have been strongly advised to purchase travel insurance to offset any financial losses due to cancellations.
